LABOUR MARKET TESTING CHANGES EFFECT 08/12/2023
THIS RELATES TO ADVERTISEMENTS PLACED FOR A SUBCLASS 482TSS VISA. IT CAN ALSO BE USED FOR THE 186 PERMANENT EMPLOYER SPONSORED PATHWAY IN TERMS OF MEETING THE GENUINE POSITION REQUIREMENTS.
The requirement has been reduced from 3 to 2 methods of advertisement. Workforce Australia is no longer required.
The nominated position must be advertised in at least two advertisements on or in one or more of the following:
(a) a recruitment website with national reach in Australia;
(b) print media with national reach in Australia;
(c) radio with national reach in Australia; (d) if the approved sponsor is an accredited sponsor—the approved sponsor’s website.
Advertisements should be a continuous period.
For the avoidance of doubt, applications or expressions of interest for a nominated position may be accepted for a continuous duration of at least 4 weeks across 2 or more advertisements where each advertisement for the nominated position overlaps either:
(a) the first day on which the next advertisement for the nominated position is published; or
(b) the last day on which the preceding advertisement for the nominated position is published.
For the purposes of determining the total number of days for a continuous duration, any day or days that overlap may only be counted once.
